Screaming NZ Legal News . .Wed, 22 May 2013 13:31:11 +0000en-UShourly1http://wordpress.org/?v=3.5.1Peace Throughout the Land? Bah, humbug
http://screaminglawyer.com/peace-throughout-the-land-bah-humbug.php#commentsSun, 12 Dec 2010 20:55:01 +0000adminhttp://screaminglawyer.com/?p=1072It was refreshing to see Robert Fisher QC’s comments in the past NZ Lawyer magazine saying that he’s generally in favour of disputes and that “the last thing we need is harmony throughout the land.” Good heavens, to say such a thing on what is virtually the eve of Christmas. It’s like Gordon Gekko saying “Greed is good”. Look where that got us. His caveat was that disputes between those charged with resolving them was taking the edict too far. The Fisher comments were essentially focused on the fact that those in dispute generally want some form of “substantive help” from mediators to assess the merits of their dispute, which is doubtless absolutely correct. Meanwhile, joining the swelling ranks of the former jurists who have joined the disharmony throughout the land is Sir Hugh Williams QC, advertising to help with some disharmony near you now. Don’t delay. Discounts may apply for the first through the former Judge’s door.

They now have a significant opportunity to enter the real estate market he told a function held at the West Auckland offices of lawyer and realtor Rhonda Evans. Temm said that practitioners had for many years very much undervalued themselves in the transactional side of their work. The changes introduced by the Lawyers & Conveyancers Act 2006 meant that it was open to the profession to begin marketing and selling real estate. Temm said that in Scotland, 85 per cent of real estate was sold by lawyers.

The UK’s three biggest legal regulators have launched a review of legal education and training because of ‘lawyer oversuppy’. The Lawyer reports that the review by the Solicitors Regulation Authority, the Bar Standards Board and the Institute of Legal Executives Professional Standards will examine routes to qualification and the requirements placed on law schools in light of the likely future shape of the legal market. According to the Law Society, 7,000 people completed the Legal Practice Course (LPC) in 2008, but there are only 6,000 training contracts available this year.

The jobs seek everyone from a director of the PBS to litigators.

In the final version of Crude — the 2009 documentary on the epic environmental suit brought by Amazon tribespeople against Chevron Corporation in Ecuador — lead U.S. plaintiffs’ attorney Steven Donziger remarks: “This is something you would never do in the United States, but Ecuador, you know, this is how the game is played, it’s dirty.” So check out the tapes on this at Law.com – it’s all fascinating, weird, and . . well, dirty.

The now sort-of-but-not-quite-yet fulltime Auckland branch of the C of A – the nation’s judicial engine room – has been shunted away across town.

The turbo-driven law-making has bypassed or overriden a few centuries of legal safeguards in the click of a mouse and now has the Law Society president Paul Temm and quake-shaken Austin Forbes QC of Christchurch, convenor of the Rule of Law committee, speaking up about its overarching and potentially dangerous, if well intentioned, powers. After all, we all know what they say about absolute power.

http://screaminglawyer.com/lawyering-on-in-christchurch.php#commentsThu, 09 Sep 2010 02:57:25 +0000adminhttp://screaminglawyer.com/?p=812John Bowie – God and the government must be really mad with Canterbury. First the finance company, now the earthquake. But, it seems, the government has now come round even if God may still be making up His mind. And, for politicians anyway, it has to said that this is their Giuliani moment as Key and Parker shine in the tremulous light of Christchurch. Jim Anderton must be chaffing badly. God wasn’t with him, either.
For lawyers, the quake and its after shocks caused obvious problems with accommodation, but didn’t slow things up unduly for the larger firms, although some were clearly better prepared for disaster than others. Chapman Tripp quickly holed up in the All Seasons Hotel to continue business, while others worked from home. Those with an office network, like Duncan Cotterill, were able to direct phone and other traffic through their Nelson office. Buddle Findlay of course have Wellington and Auckland.
One of the better prepared local firms was Cavell Leitch, which has suburban offices in New Brighton and Riccarton. The firm swiftly moved operations there, using offsite IT backup to maintain access to computers, faxes and payment facilities. As with other firms, the major hassle in the city was getting through the police cordon to check the office. The Law Society moved quickly, appointing spokesmen to direct concerned clients to the appropriate people for advice. Despite the moves, many clients have remained anxious about the state of their files and records which so far as can be determined remain safe and secure.

It’s from the Legal Intelligence and it makes a lot of sense for those who are tossing and turning and tossing …
